This privacy policy outlines Resmart’s practices in connection with the information you provide us when you interact with Resmart through our office, websites (the “Websites”), mobile applications (the “Apps”) and/or other services (collectively, the “Services”). By using any of the Services, you consent to Resmart’s collection, use and sharing of your personal information in accordance with this Privacy Policy.

 

2. Important information regarding use of the Services and third parties.

 

We use third parties to provide certain Services. Some of our Services may contain links to third parties’ websites. This Privacy Policy does not address, and we do not control and are not responsible for the content, security, or privacy practices of any third parties, including any third party operating any site or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

In addition, we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Facebook, Twitter, LinkedIn (collectively “Social Media Pages”) Apple, Google, Microsoft or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, including any information you disclose to other organizations through or in connection with the Apps or our Social Media Pages.

The Services are operated in the United States and are not intended for use by residents or companies of any country outside of the US. The Services and our collection, use and sharing of your information is governed solely by US law.

 

3. What information is collected by Resmart?

 

We collect information when you interact with us, including, but not limited to, your first and last name, mailing address, e-mail address and telephone number. In some circumstances, we (or our service providers) may also collect: date of birth or age; purchase/return/exchange information; list information; information concerning your mobile device (including, without limitation, browser and device information); information concerning how you use our Websites and Apps; certain debit/credit card information; and geo-location; information collected through cookies, pixel tags and other technologies; temporary or persistent unique device identifiers; and/or demographic information.

 

If you submit any information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

 

 

4. How does Resmart collect information?

 

We and our service providers may collect information in a variety of ways, including when you:

  1. Make an online purchase;
  2. Return, exchange or request information about our products;
  3. Create an online account or sign up for e-mails or mobile text messages regarding special offers;
  4. Participate in a contest, promotion or sweepstakes;
  5. Provide us with comments or suggestions through the Services.

 

We and our service providers may also collect information in a variety of other ways, including:

  1. Through your browser or device: Certain information may be collected via your browser or through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version, the name and version of the Services (such as the App) you are using, battery usage, battery charge and battery state.
  2. Through your use of the App: When you download and use the App, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number.
  3. Using Cookies: Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences, and other anonymous traffic data.
  4. Using pixel tags and other similar technologies: Pixel tags (also known as web beacons and clear GIFs) may be used in connection with some Services to, among other things, track the actions of users of the Services (including email recipients), measure the success of our marketing campaigns and compile statistics about usage of the Services and response rates.
  5. We use Google Analytics, which uses cookies and other, similar technologies to collect information about use of the Services and reports website trends.   6. IP Address: Your IP address is a number that is automatically assigned to the computer or mobile device that you are using by your Internet Service Provider (ISP). An IP address may be identified and logged automatically in our server log files whenever a user accesses the Services, along with the time of the visit and the page(s) that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications and other services.
  7. Physical Location: We may collect the physical location of your device and/or other location attributes (such as fenceID, speed, altitude, accuracy, and bearing) by, for example, using satellite, cell phone tower or WiFi signals. In some instances, you may be permitted to allow or deny such uses and/or sharing of your device’s location, but if you do, we and/or our marketing partners may not be able to provide you with the applicable personalized services and content. Geolocation services can be turned off or on via the Settings Area of the Apps or in the Location Services area of your mobile device. You can stop all collection of such information by the Apps by uninstalling the Application. You may use the standard uninstall processes as may be available as part of the mobile device’s operating system or via the mobile application marketplace or network.
  8. By aggregating information: Aggregated information does not personally identify you or any other user of the Services (for example, we may aggregate personal information to calculate the percentage of our users who have a particular telephone area code).

How does Resmart use my information?

 

We and our service providers may use your information:

  1. To communicate with you about your use of the Services;
  2. To complete and fulfill your purchase, for example, to process your payment, have your order delivered to you, communicate with you regarding your purchase and provide you with related customer service.
  3. To ensure that the Services are functioning properly and to improve their design and functionality.
  4. To facilitate navigation, to display information more effectively, and to recognize your computer in order to assist your use of the Services
  5. For our business purposes, such as audits, security, fraud monitoring and prevention, enhancing, improving or modifying our Services, identifying usage trends, determining the effectiveness of our promotional campaigns and operating and expanding our business activities.
  6. To track responses to our online advertisements and marketing emails and/or the effectiveness of marketing campaigns.
  7. To personalize your experience on the Services by presenting products, advertisements and offers tailored to you and/or to provide you with personalized location-based services and content
  8. For other lawful purposes consistent with your use of the Services.

 

If you have created an account on our Websites, you have the opportunity to e-mail shopping lists and/or product pages to your friends. In order to accomplish this, you must provide your friend’s name and e-mail address to us. By using this functionality, you are telling us that you are entitled to provide us with your friend’s name and email address. 


 

6. Does Resmart collect the personal information of children?


 

The Websites and Apps are not designed for or directed to children under the age of 16, and Resmart does not knowingly collect online the personal information of children under the age of 16.

 

7. How might Resmart share my information?

 

Resmart may share your information with or to:

  1. Our affiliates, selected product vendors, and trusted partners with whom we have a business relationship in order to address a product concern, or to notify you of special offers and promotions relating to such companies’ products available through Resmart;
  2. Service providers who help us provide a particular operation and its services (e.g., electronic commerce, digital coupon platform). Examples of the services performed by these third-party service providers include:
    a. payment processing and authorization;
    b. fraud protection and credit risk reduction;
    c. order fulfillment and shipping;
    d. marketing and promotional material distribution.

8. Our Advertising

 

We may use third-party advertising companies to serve advertisements tailored to you, based on information relating to your use of the Services and/or other websites or online services on any of your devices, as well as on information received from third parties. To do so, these companies may place or recognize a unique cookie on your browser (including through the use of pixel tags). They may also use these technologies, along with information they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop.

If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please immediately notify us in accordance with the “Contacting Us” section below.

 

10. How do I review the information Resmart has about me?

 

If you would like to review, correct or update the personal information that we have collected about you, you may do the following, depending on the type of information and how it was collected:

Information for Accounts Created on Our Websites:

  1. If you have created an account on our websites or Apps, you can access your information at any time by clicking on the “My Account” link.

Information We Have Collected and Retained:

  1. If you would like to review or correct any personal information, we have collected about you, please send an e-mail request to [email protected].
  2. All such e-mail requests must be written in the English language. In your request, please make clear the information that you would like to review or have corrected; however, please do not send or disclose to us any sensitive information (defined in Section 15 below) in such request.
  3. For your protection, we may need to verify your identity before acting on your request. We will try to comply with your request as soon as reasonably practicable.
  4. Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change (e.g., when you make a purchase or enter a promotion, you may not be able to change the personal information provided until after the completion of such purchase or promotion). There may also be residual information that will remain within our databases and other records, which will not be removed or changed.
  5. Information You Provided in Connection with A Promotion or Sweepstakes

11. What are my choices regarding Resmart’s collection, use and sharing of my information?

1. If you no longer want to receive marketing-related e-mail from Resmart, such as e-mails relating to offers or promotions, you can opt-out by selecting the unsubscribe link located within any such e-mail.
2. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to automatically decline cookies or be given the choice of declining or accepting the transfer to your computer of a particular cookie (or cookies) from a particular site. You may also wish to refer to http://www.allaboutcookies.org/manage-cookies/index.html. If, however, you do not accept cookies, you may experience some inconvenience in your use of the Services. For example, we may not be able to recognize your computer, and you may need to log in every time you visit. You also may not receive advertising or other offers from us that are relevant to your interests and needs.

We will try to comply with your request(s) as applicable and as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt-out.

12. Can Resmart change this Privacy Policy?

Yes. We will post any changes to this Privacy Policy here so that you will always be aware of our privacy practices. Please refer back to this Privacy Policy regularly. The “Last Modified” legend at the top of this page indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services. Your continued use of our Services following our posting of any such changes will mean that you accept such changes.

13. California Do Not Track Policy

Some browsers have a “do not track” feature that may transmit "do not track" signals to the websites and other online services with which the browser communicates. At this time, we do not currently participate in any “Do Not Track” (DNT) systems that would allow us to respond to such browser “do not track” signals.

Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), Resmart provides the following additional details regarding the categories of Personal Information about California residents that we have collected or disclosed within the preceding 12 months. This CCPA Notice does not pertain to the Personal Information that we have collected about a California resident in the course of such person acting as a job applicant to, an employee of, director of, officer of, or contractor of Resmart (to the extent that the such person’s Personal Information is or was collected and used by Resmart solely within the context of the person’s role or former role as a job applicant to, an employee of, director of, officer of, or a contractor of Resmart).

We collected the following categories of Personal Information:

1. Identifiers, such as name, contact information, online identifiers and other government-issued ID numbers;
2. Personal Information, as defined in the California customer records law, such as name, contact information and financial information;
3. Commercial information, such as transaction information, purchase history and financial details;
4. Internet or network activity information, such as browsing history, online behavior, and interactions with our and other websites, applications and systems;
5. Geolocation data, such as device location and IP location;
6. Characteristics of protected classifications under California or federal law, such as age;
7. Call recordings created in connection with our business activities; and
8. Inferences drawn from any of the Personal Information listed above to create a profile or summary about, for example, an individual’s preferences and characteristics.

 

We collect this Personal Information from you and from other categories of sources: publicly available databases, our service providers, social networks and our Social Media Pages, and joint marketing partners, when they share the information with us.
We share this Personal Information with selected product vendors; service providers; third-party sponsors of sweepstakes, contests, and similar promotions; business partners and auditors.

For purposes of this CCPA Notice, “sold” or “sale” means the disclosure of Personal Information for monetary or other valuable consideration but does not include, for example, the transfer of Personal Information as an asset that is part of a merger, bankruptcy, or other disposition of all or any portion of our business.

1. Disclose to you the following information covering the 12 months preceding your request:
a. The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information;
b. The specific pieces of Personal Information we collected about you;
